Nun ja, nicht ganz.

1.) Das Gesetz wurde vollständig für nichtig erklärt. Es müsste komplett neu formuliert und beschlossen werden. Dazu wäre erst mal eine Regierungsvorlage nötig, und für diese beim gegenwärtigen Stamd die Zustimmung der FDP. Die FDP war aber immer dezidiert gegen die VDS.

Selbst wenn sie wollte, kann die FDP diesen klaren Standpunkt nicht so leicht zum Müll befördern.

2.) Der Verfassungsgerichtshof hat für eine allfällige "VDS neu" einen umfangreichen Katalog von Bedingungen formuliert, um die gespeicherten Daten vor Diebstahl, Missbrauch, Hackern, unbefugter Abfrage etc. zu schützen. Sie also zu sichern, und das wirklich radikal. (Der Katalog stammt im Wesentlichen aus einem Gutachten des CCC.)

Es ist dzt. nicht klar, wie diese kombinierte Maßnahmensammlung technisch überhaupt realisierbar ist, und zugleich die Daten auf vernünftige Weise zugreifbar zu halten. (Der CCC hat ganze Arbeit geleistet. ;-))

In jedem Fall schrauben diese (unbedingten) VfGH-Forderungen die Kosten radikal in die Höhe.

Aus beiden Gründen besteht gute Hoffnung, dass man die Sache einfach bleiben lässt. Zumal beim Wähler damit ohnehin nichts mehr zu gewinnen ist, nach den intensiven Debatten der letzten zwei Jahre.
